General Terms and Conditions of Sale (GTC) - Madame Élégante

Article 1 - Purpose

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the sole proprietorship Madame Elégante and its customers in connection with the online sale of clothing and, depending on the suppliers, jewelry and accessories. Any order placed on the website www.madame-elegante.com implies unreserved acceptance of these GTC.

Article 2 - Seller's Identity

Article 3 - Products and prices

The products offered for sale are presented on the website with their descriptions and prices. Prices are indicated in euros, inclusive of all taxes ( VAT not applicable , as per article 293 B of the French General Tax Code). Madame Elégante reserves the right to modify its prices at any time, but products will be invoiced based on the prices in effect at the time the order is validated.
In the event of a product modification (out of stock, change of characteristics), Madame Elégante will inform the customer before the order is validated.

Article 4 - Orders and payment

The customer can order from the website www.madame-elegante.com . Payment is secure and can be made by credit card and Apple Pay. PayPal may be added later. The order is confirmed after payment is validated. If the payment fails, the order will not be validated. The customer may then place a new order. Once payment has been made and the order validated, it cannot be canceled. The customer will not be able to modify or cancel the order after payment confirmation. If the customer wants a different product or a change, they must return the item upon receipt and place a new order.

Article 5 - Delivery

Madame Elégante delivers in France via:
  • GLS FlexDelivery home delivery: 24 to 48 hours (excluding weekends and public holidays)
  • GLS collection point: 24 to 48 hours (excluding weekends and public holidays)
  • Mondial Relay (collection point): 3-6 business days
  • Tracked letter for parcels under 100g: 1 to 3 business days

IMPORTANT: The GLS collection point is selected once payment has been validated.
If no collection point is selected when preparing the order, the nearest collection point will be automatically assigned and cannot be changed.
And in Belgium via:
  • GLS FlexDelivery home delivery: 2 to 3 business days
The delivery times are given as a guide only. In case of delay, Madame Elégante cannot be held responsible.

Article 6 - Right of withdrawal and returns

In accordance with Article L. 221-18 of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal.
Return conditions

Article 7 - Defective products or order error

In the event of a defective product or order error, the customer has 14 days to contact Madame Elégante at contact@madame-elegante.com with a photo of the product and their order number. In accordance with Articles L. 217-4 to L. 217-14 of the French Consumer Code, a refund, including delivery charges, will be issued if the product is deemed non-compliant. If the customer prefers, a replacement product may be offered, subject to availability.

Customer service is committed to responding within 48 hours.

Article 9 - Dispute Resolution and Mediation

In the event of a dispute, the customer should first contact Madame Élégante directly at contact@madame-elegante.com to attempt to resolve the dispute amicably. If no satisfactory solution is found after this initial contact, the customer may then resort to a consumer mediator free of charge, in accordance with Article L. 612-1 of the French Consumer Code.
Madame Elégante is in the process of joining a mediation service and will communicate the details to her clients as soon as the information is available.
The customer will be able to consult the mediator via [name of the mediation service] whose contact details will be made available on the website.

Article 10 - Protection of personal data

The information collected on this website is necessary for order processing. It is processed in accordance with the GDPR and is only shared with essential departments (payment, delivery). Customers have the right to access, modify, and delete their data by contacting contact@madame-elegante.com
The customer is informed that their informed consent is requested for the collection of their personal data during the ordering process (checkboxes). For more details, please consult the website's privacy policy.

Article 11 - Applicable Law

These Terms and Conditions are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

Article 12 - Guarantees

Legal and commercial guarantees
1. Legal guarantee of conformity
In accordance with articles L.217-4 to L.217-14 of the Consumer Code, you benefit from the legal guarantee of conformity on all products purchased from our store.
Warranty conditions:
- The product must conform to the description and specifications that were provided at the time of ordering.
-You have a period of 2 years from the receipt of the goods to report any non-conformity.
In case of non-compliance, you are entitled to a repair or replacement of the product, free of charge, if these solutions are possible.
-If repair or replacement is impossible or disproportionate, you can request a full refund or a price reduction for the product.
Exceptions: The legal guarantee of conformity does not cover:
-Defects resulting from misuse or an accident.
-Defects that appear after abnormal use of the product.
2. Warranty against hidden defects
In accordance with Articles 1641 et seq. of the Civil Code, you also benefit from the guarantee against hidden defects, which covers defects not apparent at the time of purchase and which render the product unfit for its intended use or which significantly diminish its use.
Warranty conditions:
You have a period of 2 years from the discovery of the hidden defect to report the problem.
If a hidden defect is proven, you are entitled to:
Repair or replacement of the product, if these solutions are possible.
If replacement or repair is impossible, you can request a refund or a proportional price reduction.
3. Warranty Exclusions
Legal and commercial guarantees do not apply in the following cases:
-If the product has been modified, repaired or handled incorrectly by the customer or a third party.
-If the product has been used under abnormal conditions or contrary to its intended use.
-If the product shows normal signs of wear due to its use or lifespan.
4. Implementation procedures for the guarantees
If you wish to exercise your rights under one of these guarantees, here is the procedure to follow:

Please provide the following information:
-Order number
-Description of the defect or flaw
-Photos of the defective product, if necessary
We will respond as soon as possible to explain the next steps. If the product needs to be returned, we will provide you with a prepaid return label for defective or non-compliant products.

Article 13 - Defective Products – Sale at Reduced Price

Some items may be offered at a reduced price in the "Defective" category.
These products have one or more aesthetic or functional defects (e.g., irregular stitching, small stain, snag, etc.) clearly indicated in the description and visible in the photos.
By purchasing a product in this category, the customer acknowledges having been informed of the defects and accepts the item as is.
These products come with no warranty and are neither returnable nor exchangeable .
